Department of Posts Unveils Comprehensive SOP to Strengthen Court Case Management

The Department of Posts has introduced a Standard Operating Procedure (SOP) for Handling of Court Cases with the objective of ensuring faster, more efficient, and legally compliant management of litigation across Divisions, Regions, Circles, and the Postal Directorate. The SOP, issued on 23 July 2026, seeks to address delays in filing replies, appeals, and implementing court orders, while strengthening accountability at every level.

One of the key features of the SOP is its emphasis on preventive litigation. The Department has directed that employee representations on service matters should ordinarily be disposed of within one month. If a representation involves a policy issue requiring inputs from the Directorate or another Ministry, it must be referred within seven days, helping to reduce avoidable court cases.

The SOP provides a well-defined workflow for handling cases before Consumer Commissions, the Central Administrative Tribunal (CAT), High Courts, the Supreme Court, and other judicial forums. It assigns clear responsibilities to Office Assistants, Inspectors Posts, Divisional Heads, Regional Offices, Circle Offices, and Government Counsel, along with stage-wise timelines for preparing replies, obtaining approvals, filing pleadings, and processing appeals.

To improve legal efficiency, the Department has reiterated the importance of filing counter affidavits within the prescribed timelines, ensuring timely appeals against adverse judgments, and processing all legal proposals through e-Office or official email. The SOP also encourages the use of scanned documents, virtual meetings with Government Counsel, and electronic sharing of records to minimize delays.

Another major initiative is the introduction of regular monitoring of pending litigation. Divisional Heads will conduct monthly reviews, while Regional and Circle Offices will carry out quarterly reviews of important court cases. A Litigation Monitoring Register or e-Office dashboard is also to be maintained to track hearing dates, limitation periods, case status, and responsibilities.

The SOP further lays down detailed guidelines for preparing legally sound replies and counter affidavits, reviewing the performance of Government Counsel, and determining whether appeals should be filed based on legal merit rather than as a routine practice. It also identifies priority litigation involving policy matters, substantial financial implications, and issues with nationwide impact, requiring expedited handling.

By introducing standardized procedures, fixed timelines, and technology-enabled legal processes, the Department of Posts aims to reduce unnecessary litigation, prevent contempt proceedings, improve coordination between field offices and the Directorate, and safeguard the Department's interests through timely and effective legal action.
